Please read these terms carefully before using our WhatsApp API platform.

1. Agreement to Terms

By accessing or using the WhatsApp API Platform ("Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

We provide a customer engagement platform that allows users to send and receive WhatsApp messages, integrate AI chatbots, and manage campaigns through the WhatsApp Web protocol. We are not affiliated with Meta Platforms, Inc. or WhatsApp Inc.

3. Account Registration and Security

You must register for an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Acceptable Use Policy

You agree NOT to use the Service to:

  • Send unsolicited bulk messages (spam).
  • Violate WhatsApp's official Commerce Policy or Terms of Service.
  • Harass, abuse, or harm other persons.
  • Transmit any content that is unlawful, harmful, threatening, or defamatory.
  • Distribute malware, viruses, or any other harmful software code.

We reserve the right to suspend or terminate your account immediately if you violate this Acceptable Use Policy or if your WhatsApp number gets banned due to spamming behavior.

5. Subscription Plans and Fees

Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring and periodic cycle depending on your plan. Subscription approvals are subject to verification (such as UTR check). All fees are non-refundable unless specified otherwise.

6. Limitation of Liability

In no event shall WhatsApp API, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of (or inability to access or use) the Service.
  • Any temporary or permanent suspension/banning of your WhatsApp number by WhatsApp/Meta.
  • Any unauthorized access, use, or alteration of your transmissions or content.

7. Modifications to Service and Terms

We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. We may also revise these Terms of Service from time to time. By continuing to access the Service after revisions become effective, you agree to be bound by the updated terms.

8. Governing Law

These terms shall be governed by and construed in accordance with the laws of Uttar Pradesh, India, without regard to its conflict of law provisions.
